The case-by-case basis for allowing nurse case managers: It's not mandatory to have a nurse case manager, and the decision can be made by the injured worker or their lawyer. Some lawyers never allow them, but the speaker permits them selectively to avoid unnecessary conflicts with insurance companies. Rules for nurse case managers: To prevent undue influence on the case, specific restrictions are placed on nurse case managers. These include not being allowed in the exam room, not communicating with the doctor without the injured worker or lawyer present, not dictating treatment, and providing all reports to the lawyer's office promptly. No exam room presence: Nurse case managers are prohibited from being in the examination room during the injured worker's consultation with the doctor to ensure that they do not influence the doctor’s assessment or treatment. No secret communications: Any communication between the nurse case manager and the treating doctor must include the injured worker or their lawyer, ensuring transparency and preventing unauthorized influence on medical decisions. Immediate report review: All reports and notes created by the nurse case manager must be sent to the lawyer's office immediately after they are made. This allows for monitoring of the nurse case manager’s activities and the opportunity to remove them if they act inappropriately or against the injured worker's interests. Remember, it's your choice or your lawyer's choice to have a nurse case manager involved. We provide a step-by-step guide on how to create a written agreement outlining the limitations and expectations for the nurse case manager. By setting clear boundaries, you can ensure that they do not interfere with your doctor's appointments, treatment decisions, or the course of your recovery. We also emphasize the importance of receiving all reports generated by the nurse case manager to monitor their actions closely.
