The Worker Protection Act 2023 comes into force on 26 October 2024, imposing a new, proactive duty on all employers across the UK to take reasonable steps to prevent sexual harassment in the workplace. With at least 1 in 5 men and nearly half of all women experiencing sexual harassment at work, this new compliance duty is an important step employers must prepare for. The new “preventative duty” shifts beyond reacting to complaints and requires employers to take steps to prevent harassment from occurring in the first place. Critically, the meaning of reasonable steps will vary from company to company, meaning employers will have to prove they have conducted a thorough risk assessment and understood what proactive steps look like in their business.
